  1. Introduction

    Welcome to the Skylark Villa. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Guest,” “you,” or “your”) and the owner of the Skylark Villa (“Host,” “we,” “us,” or “our”) regarding your access to and use of our vacation rental property, located at LP 197 Lot 2 Paria Main Road, Blanchisseuse, Trinidad (“the Property”), as well as your interactions with our website at https://theskylarkvilla.com.

    By submitting a booking request, confirming a reservation, using the website, or physically occupying the Property, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to any part of these Terms, you must not use the website or stay at the Property.

    The Property is a privately owned secondary residence made available for short-term vacation rental on a non-commercial basis. All bookings are subject to the terms, conditions, and disclaimers set forth herein.

    You affirm that you are of legal age and have the capacity to enter into binding contracts. You further confirm that any reservation made under your name is for lawful, personal, and recreational use only and not for any commercial, illegal, or third-party purpose.

  2. Property Overview and Booking Options

    The Skylark Villa is a 3-bedroom, 3-bathroom residential property offered for short-term stays. Depending on availability and guest preference, the following configurations may be booked:

    All bookings are subject to Host approval, availability, and receipt of required documentation and payments. By booking, you agree to the configuration selected and all accompanying limitations or shared use scenarios.

  3. Check-In, Check-Out, and Guest Access

    Early check-ins or late check-outs may be granted at the sole discretion of the Host and may incur additional fees. Unauthorized late check-outs will result in deductions from the security deposit.

    You will be provided with access instructions prior to arrival. The Guest is responsible for maintaining security and confidentiality of all access information.

  4. Payment Terms

    All fees and charges are stated in United States Dollars (USD), unless expressly indicated otherwise. Payments shall be made through secure third-party payment processors, including but not limited to Stripe or Wise. The Host does not directly collect, process, or retain any payment card information.

    To secure a reservation, the Guest is required to pay the full booking amount together with the applicable security deposit at the time of booking. No reservation shall be considered confirmed until both amounts are received in full.

    The security deposit is held as collateral against potential damages, rule violations, or other liabilities incurred during the stay. It shall be refundable following a post-check-out inspection, subject to the terms and conditions set forth in Section 6 of this Agreement.

    All payments under this Agreement, including the booking fee and the security deposit, are due in advance and must be paid in full prior to occupancy.

  5. Cancellation and Refund Policy

    Cancellations are subject to the following refund schedule, based on the number of days prior to the scheduled check-in date:

    The security deposit is always refundable in full, provided no damage, rule violation, or cost liability is found.

    Refunds, if any, will be issued to the original payment method within a reasonable time following cancellation or inspection, as applicable.

  6. Security Deposit and Damages

    A security deposit is mandatory for all bookings and is collected directly by the Host. This deposit will be held without interest and used solely to cover:

If any damage, violations, or other deductions are necessary, an itemized explanation will be provided. ****You agree to remain fully liable for any charges that exceed the amount of the security deposit.

  7. House Rules and Guest Conduct

    To ensure the safety, comfort, and enjoyment of all parties, the following House Rules apply to all guests and visitors without exception:

    Violation of these rules may result in immediate termination of your stay without refund and full forfeiture of the security deposit.

  8. Guest Responsibilities

    As a Guest, you agree to:

    Guests are responsible for the behavior of all invitees and visitors. You assume full financial responsibility for any loss, damage, or legal violation caused by yourself or your guests.

  9. Host Rights and Access

    The Host reserves the right to access the Property at reasonable times and with prior notice for purposes of maintenance, inspection, or emergency.

    In urgent situations (e.g., fire, water leak, safety threat), the Host may enter the premises without prior notice. Every effort will be made to respect your privacy and minimize disruption.

  10. Use Restrictions

    The Property may not be used for:

    Subleasing or assigning the rental to third parties is strictly prohibited. Bookings made by or for individuals under the age of 18 are not permitted unless accompanied by a legal guardian.

  11. Privacy and Data Usage

    The Host collects and processes the following categories of personal data:

    Personal data is used to confirm and manage bookings, communicate with Guests, ensure Property security, and comply with legal obligations.

    Third-party processors: Payments are processed via Stripe, Wise, or any other third-party payment processor

    Data will be stored securely and only retained for as long as legally required or operationally necessary.

  12. Third-Party Services and Referrals

    The Host may recommend or facilitate third-party services, such as:

    These services are independently operated and are not employees, agents, or representatives of the Host. By using these services, you agree that the Host bears no liability for the acts, omissions, safety, or quality of such third-party providers.

    Guests may select from a list of approved third-party service providers (e.g., transportation, catering, guided tours) as optional add-ons during the booking process. For quality assurance and consistency, all service pricing and terms are standardized and managed by the Host.

    Guests shall not contact or engage directly with referred third-party service providers for payment or service coordination. All service add-ons must be selected and paid for by the Guest at the time of booking, prior to check-in. These fees will be collected by the Host and remitted to the respective service providers on the Guest’s behalf.

    The Host facilitates access to such third-party services solely for the Guest’s convenience and does not guarantee, endorse, or assume any responsibility for the performance, availability, or conduct of any third-party provider.
